Defendant sought review from a judgment entered on a jury verdict in the Circuit Court for Richmond (Virginia), convicting him of possession of heroin and drug paraphernalia. Defendant claimed that the trial court’s jury instruction on possession of drug paraphernalia dictated a mandatory conclusion as to the issue of possession of the drug paraphernalia and ignored his proposition that a companion possessed the paraphernalia.

  • To prove constructive possession of drugs, the Commonwealth must establish that the defendant was aware of both the presence and character of the substance and that it was subject to his dominion and control. The possession of drugs need not always be exclusive. It may be shared with another. The duration of the possession is immaterial.
